With the enactment of Government Regulation No. 28 of 2024 ("GR 28"), which took effect on 26 July 2024, several important aspects regarding the maximum content levels of sugar, salt and fat (known as Gula, Garam, dan Lemak or "GGL") in processed food products will be impacted. This client alert will focus specifically on the labeling requirements established by GR 28, which is further stipulated in the draft regulation prepared by the Indonesian Food and Drug Authority ("BPOM"). One of the key requirements of GR 28 is that the production, importation or distribution of processed foods — including readyto-eat items — must include Nutritional Value Information (Informasi Nilai Gizi or "ING") on its packaging. This information will specify the levels of sugar, salt, and fat present in the products.
In general, GR 28 sets forth regulations governing various food safety and nutritional standards. In response to these regulations, BPOM is drafting new provisions ("BPOM Draft") that will serve as the implementing regulations for GR 28, specifically on labelling matters.
